Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of WitnessMe (the “Platform”, “we”, “us”). By creating an account, uploading content, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms, our Content Policy, our Cookie Policy, and our Removal Policy. If you do not agree, you must not use the Platform.

The Platform contains adult, sexually explicit material and is intended strictly for adults. You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to access or use the Platform.

By using the Platform you represent and warrant that you meet this age requirement and that it is legal in your jurisdiction to view adult content. See our Parental Controls page for information on restricting access by minors.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, to keep it up to date, and to notify us immediately of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion in accordance with these Terms.

You retain ownership of the photos, videos and other materials you upload (“User Content”). You are solely responsible for your User Content and represent and warrant that:

• You are at least 18 years of age.
• Every person depicted is at least 18 years of age at the time the content was created.
• Every depicted person has given explicit, informed and freely-given consent to be recorded and to have the content published on the Platform.
• You have all rights, licenses and permissions necessary to upload and share the content.
• The content does not violate any law or the rights of any third party.

Consent may be withdrawn at any time. Depicted individuals may request removal via our Content Removal page.

You agree not to upload, post, or share any content that:

• Depicts or involves any person under 18 years of age (“CSAM”), which is strictly prohibited and reported to authorities.
• Is non-consensual, including “revenge porn” or content shared without the depicted person’s consent.
• Depicts non-consensual acts, violence, bestiality, incest, or any illegal activity.
• Infringes intellectual-property or privacy rights.
• Is hateful, harassing, defamatory, or designed to deceive (impersonation, fraud, spam).
• Contains malware, or attempts to circumvent Platform security or scrape data.

By uploading User Content, you grant WitnessMe a worldwide, non-exclusive, royalty-free, revocable license to host, store, reproduce, display, and distribute that content solely for the purpose of operating, promoting and improving the Platform. This license ends when you delete your content or account, except to the extent the content has been shared with others or where retention is required by law. All Platform software, branding and design are owned by WitnessMe and may not be copied without permission.

We operate a notice-and-action system and may remove content or restrict accounts that violate these Terms. Where we take action, we aim to provide a statement of reasons and an opportunity to appeal. EU users should also review our EU Digital Services Act page for their rights, and our 18 U.S.C. 2257 statement regarding record-keeping.

Creators may complete identity and age verification by submitting a photo and/or a video as described in our verification process. Verified creators receive a verification badge. You choose whether your verification photo, video, both, or neither are displayed on your profile. Submitting false verification materials is grounds for immediate termination.

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Platform and its users. Provisions that by their nature should survive termination will survive.

The Platform is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not endorse User Content. To the maximum extent permitted by applicable law, WitnessMe is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Nothing in these Terms limits liability that cannot be limited under applicable law.

Your use of the Platform is also governed by our Cookie Policy. We process personal data in accordance with applicable data-protection laws, including the EU GDPR.

We may update these Terms from time to time. Material changes will be communicated through the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
